There are a number of situations where, as an employee, you can suddenly find that the identity of your employer has changed. Equally, as an employer taking over a business, you will need to understand the employee rights of your new undertaking.
TUPE Regulations – the Transfer of Undertakings (Protection of Employment) Regulations – are in place to help everyone concerned and we are highly experienced in giving advice in this situation and can guide you through the requirements of the Regulations.
Where a business, or part of a business, is sold and employment is transferred, many of the basic terms and conditions of employment may still be protected by TUPE, but before any transfer of employment takes place, there should be a proper consultation and employees have the right to be given information through their representatives about the transfer. This includes when it is likely to happen, the reason for it and any legal, economic or social implications. The new employer is also duty bound to state whether any terms and conditions are planned for employees.
